Terms of Service

These Terms of Service (“Terms”) govern the relationship between Yachtlista (“Yachtlista,” “we,” “our”) and the individual or entity (“Customer,” “You,” “Your”) using or accessing our services, applications, or platform through our website at yachtlista.com (the “Site”), or by any other means (collectively, the “Services”). These Terms explain your rights regarding listings and other content you create using the Service, your use of the Services, and other important topics. Our Privacy Policy outlines how we handle your data.

Please carefully review these Terms, along with our Privacy Policy. Together, these documents form the binding agreement between us (the “Agreement”).

This Agreement is effective when you first access or use the Services (the “Effective Date”). We may update this Agreement from time to time. Continued use of the Services constitutes acceptance of the updated Terms. If you do not agree, please stop using the Services immediately.

Yachtlista is a yacht marketplace where private sellers and licensed brokers list yachts for sale. The Services facilitate connections between buyers and sellers but do not constitute brokerage, surveying, or financial advice. You are responsible for conducting your own due diligence on any transaction.

Yachtlista collects information to provide and improve its Services. This includes information you provide directly, such as your name, email address, phone number, and listing details (yacht specifications, photos, descriptions, and pricing). We also collect technical information such as your IP address, browser type, device information, and usage data through cookies and similar technologies.

We use this data to operate the marketplace, process transactions, communicate with you about your account and listings, and improve our Services. For more details, see our Privacy Policy.

By accessing and using Yachtlista, you agree to comply with and be bound by these Terms. By agreeing, you affirm that you have read, understood, and accepted these Terms as a binding agreement. If you do not agree with any part of these Terms, please do not use the platform or access the Services.

Your acceptance also signifies your agreement to our Privacy Policy, which together with these Terms forms the entire Agreement governing your use of Yachtlista. Continued use of the Services indicates your acknowledgment of any modifications to these Terms. It is your responsibility to review the Terms periodically.

We reserve the right to deny access to the Services to any individual or entity that fails to comply with these Terms.

Yachtlista is a yacht marketplace where private sellers and licensed brokers list yachts for sale and connect with potential buyers. The platform offers two account types:

• Private Seller (FSBO): A one-time fee of $149 to list a single yacht. Your listing stays active until the yacht is sold.
• Broker: A subscription plan at $499/month or $4,500/year, providing unlimited yacht listings, a public broker profile, lead management, analytics, and priority support.

Yachtlista does not act as a broker, dealer, or intermediary in any transaction. We do not take a commission on sales. The platform provides a venue for buyers and sellers to connect, but all transactions are conducted directly between the parties involved.

We are constantly improving the Services. The Services are subject to modification and change, including features available to you. No guarantees are made with respect to the Services' quality, stability, uptime, or reliability.

The Services are provided on an “AS IS” basis, without warranties or conditions of any kind, either express or implied, including any warranties of title, non-infringement, merchantability, or fitness for a particular purpose. You are solely responsible for determining the appropriateness of using the Services and assume any risks associated with your use.

Yachtlista reserves the right to suspend or terminate your access to the Services at any time. You may not use automated tools to scrape or interact with the Services. You may not resell or redistribute access to the Services. Each user may only maintain one account.

Age Requirements

By accessing the Services, you confirm that you are at least 18 years old. If you are not old enough to enter into a binding agreement in your jurisdiction, your parent or guardian must agree to these Terms on your behalf.

By using the Services, you may provide Yachtlista with personal information such as your name, email address, phone number, billing information, and yacht listing details including photos, specifications, and descriptions. Our Privacy Policy outlines how we handle and protect your information.

In the event of a dispute arising out of or relating to these Terms, the parties will first attempt in good faith to resolve the dispute within 30 days. If not resolved, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association in accordance with its Commercial Rules. The arbitration will be conducted in English and take place in Miami-Dade County, Florida, USA.

By agreeing to mandatory arbitration, you and Yachtlista knowingly waive any right to a trial by jury. Either party retains the right to apply to a competent court for injunctive relief pending the resolution of arbitration. The arbitrator's decision will be final and binding.

Each party will bear its own legal fees and expenses. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

All payments are processed through Stripe. By using the Services, you agree to provide accurate and complete payment information and authorize Yachtlista or its payment providers to charge the applicable fees to the payment method you provide.

Private Seller (FSBO): A one-time fee of $149 is charged when you post your listing to the marketplace.

Broker subscriptions: Broker plans are billed monthly ($499/month) or annually ($4,500/year). Your subscription begins immediately upon checkout and renews automatically at the end of each billing period unless cancelled.

Yachtlista is not responsible for any issues arising from third-party payment services, including delays, errors, or unauthorized transactions. If payment is not successfully processed, we reserve the right to suspend your access to the Services until all outstanding fees are resolved.

Private Seller (FSBO)

The $149 listing fee is charged when you post your listing to the marketplace. This is a one-time, non-refundable charge. Once payment is made and your listing is live, no refunds will be issued.

Broker subscriptions

Broker plans are billed monthly ($499/month) or annually ($4,500/year). Once you subscribe, you get immediate access to the broker dashboard and can post unlimited listings. All fees are non-refundable. You may cancel your subscription at any time through your account settings. Upon cancellation, your access and listings remain active until the end of the current billing period. No partial or prorated refunds are issued.

Price changes

We reserve the right to change our pricing at any time. For active broker subscribers, price changes will take effect at the start of your next billing period. We will notify you of any price increases at least 30 days in advance. If you do not agree with the new pricing, you may cancel before the next billing period begins.

We provide the Services on an “as is” basis, and we make no promises or guarantees about their reliability, suitability, or availability.

You understand and agree that Yachtlista will not be liable to you or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential, or exemplary damages, however they arise. Our aggregate liability under this Agreement will not exceed the amount you paid for the Services in the 12 months preceding the claim.

You are solely responsible for your use of the Services. If you cause harm to someone else or become involved in a dispute with a third party due to your use of the Services, Yachtlista will not intervene or be held liable.

You retain ownership of all content you create and upload to Yachtlista, including photos, descriptions, and listing details. By posting content to the marketplace, you grant Yachtlista a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute that content for the purpose of operating, promoting, and improving the Services.

You are solely responsible for ensuring that all content you provide complies with applicable laws and this Agreement, and that you have the necessary rights and permissions to use and share such content.

This license does not affect your ownership rights over your content. Your ownership persists even if you cancel your account. The license to Yachtlista survives termination of this Agreement only to the extent necessary to remove your content from cached or archived systems.

Yachtlista reserves the right to update or replace these Terms, or to modify, suspend, or discontinue the Service at any time. Changes may be communicated through the Site or via email. It is your responsibility to regularly review these Terms. Continued use of the Service after changes have been posted constitutes acceptance of those changes.

All logos, marks, and symbols associated with Yachtlista are trademarks belonging to Yachtlista. You are not permitted to use Yachtlista trademarks or logos without prior written permission.

Subject to your compliance with this Agreement, you are granted a non-exclusive, limited, non-transferable, revocable license to access and use the Service for business or personal purposes. Yachtlista reserves all rights not expressly granted under these Terms. Each user must maintain a unique account, and you are solely responsible for any activity conducted under your account. A breach of these Terms may result in the immediate suspension or termination of your access without prior notice.

Yachtlista may terminate your access to all or any part of the Service at any time if you fail to comply with these Terms. Either party may terminate the Services for any reason upon written notice. If you wish to terminate your account, you may do so through your account settings. Any fees paid are non-refundable. Upon termination, all rights and licenses granted to you shall immediately terminate, but all provisions which by their nature should survive termination shall survive, including warranty disclaimers, indemnity, and limitations of liability.

You shall defend, indemnify, and hold harmless Yachtlista, its affiliates, employees, contractors, directors, suppliers, and representatives from all liabilities, losses, claims, and expenses, including reasonable attorneys' fees, that arise from or relate to (i) your use or misuse of the Service, (ii) your violation of these Terms or any applicable law, (iii) your violation of any rights of a third party, or (iv) any content you post to the marketplace. Yachtlista reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. This indemnity obligation survives the termination of this Agreement.
